Fitness Activity Acknowledgment & Assumption of Risk
Please read this Acknowledgment carefully. It explains the risks involved in physical activity and your responsibilities when using Genvori. It is separate from the Terms of Service, Privacy Policy, and Code of Conduct.
1. Purpose of this acknowledgment
This Fitness Activity Acknowledgment & Assumption of Risk ("Acknowledgment") explains the risks involved in physical activity and describes your responsibilities when you use Genvori Fitness. It applies to all physical activity you perform in connection with Genvori, including activities suggested, assigned, tracked, or discussed through the platform or with a coach.
This is an alpha-stage document prepared for the Genvori alpha. It is intended to be reviewed by qualified legal counsel and may be replaced or revised. It does not claim to eliminate every possible form of liability, and it does not limit any responsibility that cannot be limited under applicable law.
2. Voluntary participation
Participation in physical activity is voluntary. You choose whether to perform any exercise, program, task, or activity, and you may stop at any time. Genvori does not require you to perform any specific activity.
3. Inherent risks of physical activity
Exercise, fitness programs, strength training, cardiovascular activity, stretching, mobility work, sports, and other physical activities involve inherent risks. These risks exist even when an activity is performed carefully and correctly. Potential risks can include:
- Muscle soreness, strains, and sprains;
- Falls, slips, collisions, and accidents;
- Injuries related to equipment, surfaces, or surroundings;
- Aggravation of existing conditions, injuries, or illnesses;
- Fractures and other musculoskeletal injuries;
- Cardiovascular complications and other medical events;
- Serious injury; and
- In rare circumstances, death.
This list is illustrative and not exhaustive. Other risks may exist that are not described here.
4. Your responsibility for your own safety
You are responsible for considering your own abilities, physical condition, health, surroundings, and equipment before performing any activity, and for choosing activities that are appropriate for you. You are responsible for using equipment safely and for the environment in which you exercise.
5. Stopping activity and seeking help
You should stop an activity if you experience concerning pain, dizziness, faintness, chest pain, unusual shortness of breath, or any other potentially serious symptom. When necessary, you should seek appropriate medical help promptly. In an emergency, contact emergency services.
6. Genvori is not a healthcare provider
Genvori is a fitness and wellness technology platform. Genvori is not a healthcare provider, medical practice, or emergency service. Genvori does not provide medical diagnosis, medical treatment, emergency care, or individualized medical advice, and cannot assess your individual medical suitability for exercise.
7. AI-generated information
Genvori includes AI-assisted features. Information generated by Genvori or its AI features is general fitness and wellness information only. It is not medical diagnosis, medical treatment, emergency care, or individualized medical advice, and it may be incomplete or inaccurate. You should use your own judgment before acting on it.
8. Seek qualified medical advice
You should seek advice from a qualified healthcare professional when appropriate, particularly if you have health concerns, a medical condition, an injury, or uncertainty about whether an activity is appropriate for you.
9. Coaches and clients remain responsible
Coaches and clients remain responsible for their own actions, decisions, and judgments within the coaching relationship. Coaches on Genvori provide general fitness guidance within the scope of their actual qualifications and are not acting as your healthcare provider.
10. No guarantee that activity is free from risk
Genvori facilitates tools and communication between users and coaches. Genvori does not guarantee that any exercise, program, task, coach recommendation, AI-generated information, or fitness activity will be free from risk, error, or injury.
11. Assumption of risk
To the extent permitted by applicable law, you acknowledge that you understand the risks described in this Acknowledgment and you voluntarily assume the ordinary and inherent risks associated with participating in fitness activities through or in connection with Genvori.
12. Release and limitation
To the extent permitted by applicable law, you agree to release and hold harmless Genvori from claims arising from the ordinary and inherent risks of physical activity that you have knowingly assumed by accepting this Acknowledgment. This release does not apply where it is not permitted by law, and nothing in this Acknowledgment excludes or limits liability for negligence, unlawful conduct, or any other responsibility that cannot be excluded or limited under applicable law. This Acknowledgment does not make Genvori immune from every possible legal claim, and it does not apply regardless of the circumstances.
13. Alpha notice
This Acknowledgment is an initial draft prepared for the Genvori alpha and is subject to revision. When a new version is introduced, you may be asked to review and accept it before continuing to use Genvori.
